§ 12-1. Railroad blocking highway

  • (a) It shall be unlawful for any person to cause or permit a locomotive engine, switch engine or train to block any parish road or any highway within the parish for more than five (5) consecutive minutes. The employee of any such railroad company, present and in immediate charge of the movement of any such locomotive engine, switch engine or train, shall be held responsible for such movement or lack thereof, and it shall not be a defense to any charge brought under this section that such an employee acted under orders of his superior.

    (b) Any locomotive engineer, fireman, switchman, yard foreman, conductor or other agent or employee of any railroad company or any other person, corporation or association that shall violate any of the provisions of this section shall, upon conviction, be fined not to exceed five hundred dollars ($500.00) or be imprisoned not more than thirty (30) days, or both, at the direction of the court.
