§ 4-37. Nuisances—Infractions

  • (a) Violations: Violation of any of the following requirements or standards constitutes a nuisance and shall be infraction.

    (1) The owner or keeper of any dog shall not allow it to be at large and not under control wherein such animal creates a nuisance factor to public and private property and/or the welfare of others.

    (2) All female dogs, while in season, shall be confined in a clean, dry place not accessible to male dogs and kept there during the entire heat season (three (3) weeks), except for the purpose of planned breeding and with the knowledge of the owner of the male dog.

    (3) No owner or keeper of any dog shall allow it to bark continuously for more than a reasonable amount of time. For the purposes of this article thirty (30) minutes or longer shall be considered unreasonable.

    (4) No person, other than the owner, keeper or other authorized person is permitted to release any animal from confinement.

    (b) Penalty: Any person violating any provision of this article shall be punished by a fine of five hundred dollars ($500.00) or imprisoned for a term of not more than thirty (30) days or by the performance of community service of not more than forty (40) hours if directed by the court, or any combination of same if directed by the court.
