§ 8-2. Authority to establish temporary burning ban; violations; penalties

  • (a) The police jury hereby authorizes the parish president to impose a temporary burn ban within the unincorporated areas of the Parish of Natchitoches when weather conditions warrant.

    (b) Any temporary burn ban imposed by the parish president shall prohibit all outdoor burning until such time as the parish president determines that weather conditions are safe enough to cancel the burn ban.

    (c) The following agencies shall be notified upon issuance of a burn ban and at such time as the burn ban is lifted:

    (1) Police jury.

    (2) Police juror in whose police jury district a burn ban is issued.

    (3) Sheriff's department.

    (4) Parish Communications District No. 1.

    (5) All local news media.

    (d) Any person, company or corporation, or any person who is individually representing or acting as an agent for such person, company or corporation, who violates this section shall be guilty of a misdemeanor, and shall be punished as provided in subsection (f) of this section.

    (e) Prosecution under this section shall not affect any violator's civil liability to any party damaged as a result of any fire set by the violator.

    (f) Penalty.

    (1) Whoever violates the provisions of this section or any part thereof shall be subject to immediate revocation of their permit and further shall be punished as provided in the subsection (f)(2).

    (2) Penalty for violations. Violation of this section shall result in a minimum fine of one hundred dollars ($100.00), plus costs, and each subsequent violation in the same calendar year shall result in a minimum increase in the fine of fifty dollars ($50.00), (i.e. one hundred dollars ($100.00) for the first offense, one hundred fifty dollars ($150.00) for the second offense, two hundred dollars ($200.00) for the third offense, etc., plus costs).
