§ 9-9. Tennessee Gas and Transmission Company

  • (a) Franchise granted. There is hereby granted to Tennessee Gas & Transmission Company, a corporation organized and created under the laws of the State of Tennessee, its successors and assigns, a nonexclusive franchise, right and privilege to construct, operate and maintain in, over, along and under the public highways of the Parish of Natchitoches, Louisiana, not within the limits of any incorporated city, town or village, a pipeline, or pipelines, telephone, telegraph and other communication transmission lines and also lines for the transmission of electrical energy for the cathodic protection of the steel pipes against corrosion when constructed in accordance with the requirements adopted by the director of highways of the State of Louisiana with respect to pipelines and telephone, telegraph and other communication transmission lines and lines for the transmission of electrical energy for the cathodic protection of the steel pipes against corrosion laid under state highways.

    (b) State requirements. This section is issued under and by virtue of the various acts of the legislature of the State of Louisiana, authorizing the police juries of the parishes of said state to grant franchises for the crossing of the roads and highways of the various parishes, and where said pipelines, communication lines and lines for the transmission of electrical energy for the cathodic protection of the steel pipes against corrosion cross state highways they shall be governed by the provisions of the state highway acts applicable thereto.

    (c) Indemnity. The grantee herein named in accepting this franchise agrees and guarantees to hold harmless the police jury of the Parish of Natchitoches, Louisiana, and its individual members from any and all loss, damages or expense which they may suffer on account of the grant of this franchise and privilege and operations thereunder arising from any cause whatsoever in favor of any person, persons, partnership or corporation.

    (d) Duration. This franchise shall continue in full force and effect for a period of ninety-nine (99) years from and after the date of the adoption of this section.
