§ 9-10. Defense Plant Corporation

(a) Franchise granted. There is hereby granted to Defense Plant Corporation (a corporation created by [the] Reconstruction Finance Corporation pursuant to section 5(d) of the Reconstruction Finance Corporation Act of Congress, as amended), its successors and assigns, a nonexclusive franchise and right to lay, operate, renew, alter, inspect and maintain a pipeline or pipelines for the transportation of oil, gas, petroleum products or any other material or substance which can be transported through a pipeline, or any one or more of said substances, in, over, under and/or along the public roads and highways of the Parish of Natchitoches, State of Louisiana, not within the limits of any incorporated city, town or village, in accordance with the requirements, rules and regulations of the director of [the] department of state highways of the State of Louisiana, in such cases made and provided.

(b) Indemnity. The Defense Plant Corporation, and its successors and assigns, in accepting the franchise and right by this section granted, agrees to save and hold harmless the police jury of the Parish of Natchitoches, State of Louisiana, from any loss, damage or expense which it may suffer as a result of the construction, maintenance and operation of said pipeline or pipelines.

(c) State requirements. This section shall not become effective unless the department of highways of the State of Louisiana shall grant to the Defense Plant Corporation, its successors and assigns, the right and authority to lay a pipeline or pipelines in the rights-of-way of state highways, and the rights herein granted shall be subject to the same conditions as may be contained in such state highway permits.
