§ 11-10. Care, maintenance and operation of parish vehicles and equipment

  • (a) Generally. The driver or operator of any parish-owned vehicle or unit of equipment shall see that said vehicle or unit of equipment is:

    (1) Kept clean and in safe operating condition at all times.

    (2) Washed, greased and oil changed at regular intervals as prescribed for that particular type of vehicle or equipment.

    (3) Operated in a safe manner in accordance with all state and parish regulations relative to the operation of vehicles and equipment on state and parish roads and highways.

    (b) Inspections. All foremen and supervisory personnel shall inspect, on a weekly basis, all vehicles and equipment under their supervision to assure compliance with subsection (a) and shall report any violations thereof to the shop foreman.

    (c) Accident reports—By driver. The driver or operator of any parish-owned vehicle or unit of equipment shall immediately report any personal injury, property damage or vehicular accident to his foreman or supervisor.

    (d) Same—By supervisor. All foremen and supervisory personnel shall immediately forward any report of personal injury, property damage or vehicular accident to the secretary-treasurer of the police jury.

    (e) Investigation of accidents. All vehicular accidents shall be investigated by the vehicle/equipment code violation committee.

    (f) Penalties—Accidents. Penalties for drivers or operators of equipment involved in accidents shall be:

    (1) First accident. Mandatory suspension without pay for not less than three (3) consecutive workdays nor more than five (5) consecutive workdays. Such period of suspension shall be determined by the vehicle/equipment code violation committee.

    (2) Second accident. Mandatory termination.

    (g) Same—Violations. Penalties for the violation of any portion of subsections (a)—(d) of this section shall be as follows:

    (1) First offense. The employee shall be suspended without pay for three (3) consecutive workdays.

    (2) Second offense. The employee shall be brought before the vehicle/equipment code violation committee. The committee shall, at its discretion, either terminate the employee or suspend the employee without pay, for whatever period of time it feels appropriate for the particular violation.
